Elites Program - Terms and Conditions

Welcome to the terms and conditions (“Terms”) for Tiff’s Treats Elites® program (“Elites”). These Terms are between you and Tiff’s Treats Holdings, Inc., and/or its affiliates (“Tiff’s Treats,” “we,” “us,” or “our,” as the context may require) and govern your respective rights and obligations.
 
The latest version of these Terms will be posted on www.cookiedelivery.com (the “Site”), and you should review these Terms before signing up for an Elites membership (“Membership”). Please note that your use of the Site and Membership are also governed by our Terms and Conditions and Privacy Policy, which, together with these Terms form an binding agreement you and us (“Agreement”). If you sign up for an Elites membership, you accept the terms, conditions, limitations and requirements of this Agreement.
 
Subscription Fees and Automatic Renewal Disclosures
Elites, is a one-year subscription service.
 

All fees will charged to you saved payment method on file at the end of the Free Trial (if applicable) and on each annual renewal date thereafter unless you cancel in advance. For example, if you enroll on November 2, 2025, your next charge will be November 2, 2026, the following year.
 
If all eligible payment methods we have on file are declined, you must provide a new method promptly or your Membership may be cancelled. If successfully charged on a later date, your renewal terms will still be based on the original renewal universal.
 
Consent to Free Trial or Paid Annual Membership. To enroll, you must check a box stating: “I authorize Tiff’s Treats to start a 30-day free trial of Elites on 12/1/15. Unless I cancel before my trial ends, I understand my membership will convert to a paid annual membership and Tiff’s treats will charge $19.99 + tax for the first year to my saved payment method, and will automatically renew each year at the end-current rate until I cancel. I can cancel online, by email, or by phone at any time. I agree to Elites Terms and Conditions.”
 
After you enroll, we will email you an acknowledgement you can retain that restates these terms and how to cancel.[1] The acknowledgement will include your trial end date, the first-year amount to be charged ($19.99 + tax), the renewal terms, and how to cancel, with active cancellation links for electronic messages.
 
Please note that Elites’ Memberships cannot be purchased with Tiff’s Treats gift cards.
 
Membership Activation
By enrolling in Elites, our subscription service, through our Site, you agree to participate in Tiff’s Treats automatic renewal program subject to the following terms and conditions which constitute an agreement between you and Tiff’s Treats, which may be updated periodically by us in our sole discretion upon notice of any substantive changes. If you enroll via the Free Trial, your paid membership activates, and your first-year charge of $19.99 occurs, on the day the 30-day trial ends unless you cancel beforehand.
 
Membership Benefits
Elites members receive the following benefits:

 
Limited-Time Elites Free Trial (12/1/25 only)
If you enroll in Elites on December 1, 2025, you are eligible for a 30-day free trial (the “Free Trial”). During the Free Trial, you will receive all Elites benefits described in these Terms at no charge. A valid payment method is required at sign-up. Unless you cancel before the end of the 30-day Free Trial, your membership will convert automatically to a paid annual Elite Membership and we will charge $19.99 plus applicable tax to your saved payment method for the first year. After the first year, your Membership will renew automatically each year at the then-current annual Elites rate unless you cancel. You can cancel online or any time as described below. Free Trial enrollments cannot be purchased with Tiff’s Treats gift cards.
 
Cancelling Your Elites’ Membership
During a Free Trial, you may cancel at any time before the end of the 30-day Free Trial to avoid the first-year charge of $19.99. Free Trial benefits continue through the end of the 30-day Free Trial period.
 
You may cancel your standard Elites’ Membership at any time via a one-step only “Cancel Membership” link in your Account in Membership settings. IF you cancel on or after your first-year or renewal charge posts, your Membership will remain active through the end of that annual term. Fees are non-refundable except as expressly provided for in these Terms.
 
You may also cancel my emailing customerservice@cookiedelivery.com or by calling [toll-free number] during business hours. During your initial membership, if you cancel your Membership before i) you or your Account places your first eligible delivery order, or ii) you have received a Promotional Gift Card, then we will immediately cancel your Membership and refund you the entire amount of the Fee. If you i) have already placed a delivery order at the time of Membership cancellation, or ii) have received a Promotional Gift Card, then your Membership will expire at the end of its current annual term, and you will not receive a refund of the Fee. We do not place holds on Memberships. We will not require you to speak with an agent or accept offers to cancel. Any optional offers showing will keep a prominently located, continuously proximate “Cancel Now” control visible. We will send you a cancellation confirmation you can retain, and we will stop further recurring charges immediately.
 
FOR ANY RENEWAL MEMBERSHIP, UNLESS YOU CANCEL BEFORE YOUR RENEWAL DATE, YOUR ELITES’ MEMBERSHIP WILL RENEW FOR AN ADDITONAL YEAR AND WE WILL CHARGE THEN THEN-APPLICABLE MEMBERSHIP FEE AND ANY TAXES TO YOUR SAVED PAYMENT METHOD. FOR AN INITIAL OF ONE YEAR THAT RENEWS FOR SIX MONTHS OR LONGER, WE WILL SEND A CLEAR RENEWAL REMINDER BETWEEN 15-45 DAYS BEFORE THE CANCELLATION DEADLINE, AND IF A PROMOTOINAL OR TRIAL PERIOD EXCEEDS 31 DAYS, A REMINDER 3 TO 21 DAYS BEFORE THE INITIAL CHARGE, THAT STATES THE RENEWAL TERM, THE AMOUNT TO BE CHARGED, THE RENEWAL/CHARGE DATE, AND HOW TO CANCEL (WITH ACTIVE CANCELLATION LINKS IF SENT BY EMAIL).
 
Payment
Tiff’s Treats accepts payment via the current payment method indicated at time of purchase, which may include credit card and any other form of payment that we make available to you from time to time.
 
If all eligible payment methods we have on file for you are declined for payment of your membership fee, you must provide us a new eligible payment method promptly or your Membership will be canceled. If you provide us with a new eligible payment method and are successfully charged, your new membership period will be based on the original renewal date and not the date of the successful charge.
 
If you enrolled via the Free Trial, your first charge will occur on the day the Free Trial ends unless you cancel beforehand.
 
Fee Changes
Membership fees may change. We will provide clear, conspicuous notice of any material change, including any fee increase 5 to 30 days before it takes effect, via the contact method you selected (e.g., email or text).
 
For New York consumers, a fee increase for current members will apply only after we obtain your affirmative consent. If you are charged a higher price without having given such consent, you may cancel within 14 days of that first increased charge and we will provide a prorated refund of the remaining term.
 
From time to time, we may offer different membership terms, and the fees for such membership may vary. Tiff’s Treats does not provide price protection or refunds in the event of a price reduction or promotional offering. The Membership fee is non-refundable except as expressly set forth in these Terms. Taxes may apply on the membership fee.
 
Other Limitations
We reserve the right to accept or refuse membership in our discretion. In our sole discretion, free delivery benefits may not be eligible for large multi-recipient orders or orders created with support of the Tiff’s Treats team. We may send you email and other communications related to Tiff’s Treats and your Membership. You may not transfer or assign your Membership or any Membership benefits. From time to time, Tiff’s Treats may choose in its sole discretion to add or remove Membership benefits. Tiff’s Treats reserves the right to change the availability of the Elites program. In addition, we reserve the right to modify, suspend, or discontinue the Elites program with or without notice to you and we will not be liable to you or any third party for any such modifications, suspension, or termination.
 
Membership Termination by Tiff's Treats
We may terminate your Membership at our discretion without notice. If we do so in any year of Membership after the first year, we will give you a prorated refund based on the number of full months remaining in your Membership. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Membership, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.
 
Changes to these Terms
These Terms are subject to change by Tiff’s Treats without prior written notice at any time, in our sole discretion. If these Terms or any change to them are found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP. This provision does not apply to material changes, which include price changes, to automatic-renewal terms for consumer in jurisdictions that require advance notice and/or affirmative consent for such changes, including but not limited to New York and California. In those jurisdictions, we will follow the notice and consent rules required by law.
 
Tiff’s Rewards
Tiff’s Rewards is a loyalty rewards program of Tiff’s Treats provided as a benefit to you and other Tiff’s Treats customers. As an Elites member, participation in the Tiff's Reward program is automatic and subject to the Tiff’s Rewards Terms and Conditions, Tiff’s Treats Privacy Policy and other Tiff’s Treats rules and policies that may be applicable, including the Terms of Use.
 
Limitation of Liability
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN TIFF TREAT’S TERMS OF USE, OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST MEMBERSHIP FEE YOU PAID. THIS LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR ELITES MEMBERSHIP.
 
 You agree that you are solely responsible for (and that Tiff’s Treats has no responsibility to you for) your use of the Membership, any breach of your obligations under the Terms or Other Agreements, and for the consequences (including loss or damage of any kind which Tiff’s Treats may suffer) of any such breach.
